Terms of Service

Rules for using KiwiQuest Jobs. This is a draft for lawyer review.

Last updated: 26 April 2026. KiwiQuest Jobs (“we”, “us”) operates a website and related services that host user-submitted job listings and related content. By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. The service

We provide an online platform where employers and others can submit listings and where visitors can browse jobs, apply via links you provide, and use our public read-only APIs. Listings and outbound links are third-party information. We do not guarantee that any listing is accurate, complete, current, lawful, or that any employer or role exists.

2. Not an employment agency

We are not your employer, recruiter, or employment agency. We do not select candidates, negotiate employment, or charge placement fees to job seekers for access to listings. Any hiring relationship is solely between applicants and the party posting or operating the role. You use listings and apply links at your own risk.

3. Accounts

Accounts and authentication may be provided through our authentication provider (e.g. Clerk). You are responsible for your account credentials and for activity under your account. You must provide accurate registration information where requested. We may suspend or terminate accounts that violate these Terms or pose risk to the service or others.

4. User content

You retain ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, promote, and distribute your content in connection with the service (including in search results, emails, and public APIs), and to sublicense those rights to service providers who help us operate the platform.

You represent and warrant that you have all rights necessary to submit the content, that it does not infringe third-party rights, and that it complies with these Terms and applicable law. You are responsible for the accuracy of listings you submit.

5. Acceptable use

You must not misuse the service. Without limitation, you must not:

  • Post false, misleading, discriminatory, or unlawful job ads or content.
  • Scrape or overload the service in a way that harms availability (subject to our public API terms below).
  • Circumvent security, access non-public areas, or probe for vulnerabilities without permission.
  • Use the service to distribute malware, spam, or harass others.
  • Misrepresent your identity or affiliation.

6. Moderation and termination

We may review, refuse, edit (for formatting or clarity), remove, or restrict any content or account at our discretion, with or without notice. We may cooperate with law enforcement and respond to lawful requests. Provisions that by their nature should survive (e.g. licences granted, limitations, indemnities) survive termination.

7. Public API and reuse

We may offer public, read-only HTTP endpoints and machine-readable schemas (for example GET /api/jobs and OpenAPI). You may use them in good faith to discover and reference listings. When you display or recommend a job elsewhere, prefer linking to our canonical listing URL where we provide one, so users can see the listing on KiwiQuest.

We may change, rate-limit, authenticate, or withdraw public API access at any time. Heavy, abusive, or commercial use may require separate agreement or paid access. Data is provided “as is” without warranty; do not rely on it for safety-critical or compliance decisions without independent verification.

8. Intellectual property

The service, branding, and our original materials are owned by us or our licensors. If you believe content on the service infringes your rights, contact us with sufficient detail to assess your notice (we may remove or disable material where appropriate). 9. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service or third-party listings. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including statutory consumer guarantees where they apply).

10. Indemnity

To the maximum extent permitted by law, you will indemnify and hold harmless KiwiQuest and its affiliates, directors, and personnel against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the service, or your breach of these Terms.

11. Governing law

These Terms are governed by laws that apply to the operating entity you contract with, as determined with your legal counsel. If you are a consumer, mandatory consumer protection laws in your country may also apply and may give you rights we cannot waive.

12. Changes

We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance where permitted by law.
